Welcome to NBEworks (hereinafter referred to as “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, https://www.nbeworks.com and https://nbe.works (the “Site”), including our blog, online store, and any other services offered through the Site (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not access or use our Services.

1. Use of the Site and Services

You may use our Site and Services only for lawful purposes and in accordance with these Terms.
You agree not to:

  • 1.1 Unauthorized Commercial Use: Use our content, including but not limited to blog posts, product descriptions, images, and branding, for any commercial purpose without our express prior written consent. This includes, but is not limited to, reselling our products, using our content for advertising, or creating derivative works.
  • 1.2 Site Disruption: Attempt to gain unauthorized access to, interfere with, disrupt, damage, or compromise the security of the Site, its servers, or any connected networks. This includes, but is not limited to, hacking, introducing viruses or other malicious code, or engaging in denial-of-service attacks.
  • 1.3 Unlawful Activities: Engage in any fraudulent, misleading, deceptive, harmful, or otherwise unlawful activities on or through the Site. This includes, but is not limited to, impersonating any person or entity, making false or misleading statements, or violating any applicable laws or regulations.
  • 1.4 Prohibited Content: Post, upload, transmit, or otherwise distribute any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • 1.5 Data Mining: Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • 1.6 Reverse Engineering: Not to decompile, disassemble, or attempt to extract the source code.

2. Purchases & Payments

  • 2.1 Order Acceptance: All orders placed through the Site are subject to our acceptance. We may refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else. If your payment method has already been charged for an order that is later canceled, we will issue a full refund.
  • 2.2 Accurate Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and payment method details, so that we can complete your transactions and contact you as needed. Failure to do so, resulting in your order not being received, will forfeit your right to a full refund.
  • 2.3 Payment Processing: Payments are processed securely through third-party payment processors, PayPal and Stripe. We do not store your full payment card details on our servers. By making a purchase, you agree to the terms and conditions of the applicable payment processor.
  • 2.4 Pricing and Availability: All prices are shown in USD and are subject to change without notice. The availability of products is also subject to change without notice.
  • 2.5 Shipping:
    • 2.5.1 Shipping Costs: Shipping costs are included in the listed price of all products. There are no additional shipping charges applied at checkout.
    • 2.5.2 Delivery Times: Because all our products are shipped directly from our suppliers in China, estimated delivery times are typically between two to four week. Please note that these are estimates only and are not guaranteed. Factors outside of our control, such as customs processing, international holidays, and postal service delays in the destination country, can significantly impact delivery times. We appreciate your patience and understanding regarding potential shipping delays. We will strive to provide the most accurate estimates possible and keep you informed.
    • 2.5.3 International Shipping & Customs: We ship internationally. As the buyer (importer), you are solely responsible for any and all applicable customs duties, taxes, or import fees. Failure to pay these charges may result in your package being returned to sender, and we will not be able to offer a refund for the shipping cost or original product cost in the case it is not returned to our provider.
    • 2.5.4 Tracking: We will provide a tracking number once your order has shipped.
    • 2.5.5 Delays and Liability: While we make every effort to ensure timely delivery, we are not liable for delays caused by circumstances beyond our reasonable control. This includes, but is not limited to:
      • Customs delays and inspections.
      • Incorrect or incomplete shipping addresses provided by the customer.
      • Postal service strikes or disruptions in the origin or destination country.
      • Natural disasters, pandemics, or other unforeseen events (Force Majeure).
      • Political instability or other unforeseen events.
      • Peak seasons.
      • Holiday-related delays.
  • 2.6 Refunds & Cancellations:
    • 2.6.1 Digital Products: Due to the nature of digital products, refunds are generally not offered once the product has been downloaded or accessed. Exceptions may be made in cases of demonstrable technical issues that prevent you from accessing the product, provided you contact us within three days of purchase.
    • 2.6.2 Services (e.g. NBE Consultations or Coaching): We accept refund requests if the coaching services have yet to be performed, or if we were negligent to provide timely coaching services. If we have engaged with you for coaching or consultation services, the payment will no longer be eligible for refund. Coaching and consultation services are provided by text message, on platforms such as Discord or Telegram, or via email.
    • 2.6.3 Physical Products: We accept returns of physical products within 10 days of delivery, provided that the products are unopened. Refunds will not be issued if the product or shipment has been opened. You are responsible for return shipping costs unless the return is due to our error (e.g., a damaged or incorrect item). To initiate a return, please contact us at [email protected] to obtain a return authorization.
    • 2.6.4 Damaged or Defective Items: If you receive a damaged or defective item, please contact us immediately at [email protected] with photographic evidence of the damage. We will arrange for a replacement or refund, as appropriate.
    • 2.6.5 Cancellation Policy: Orders may be cancelled if the order has yet to have been shipped. Shipping will generally commence within 1–3 business days after the order has been placed. To cancel any orders please contact us at [email protected] and we will try our best to intervene.

3. Intellectual Property

  • 3.1 Ownership: All content on the Site, including but not limited to text, blog posts, product descriptions, images, graphics, logos, trademarks, and the “NBEworks” name and branding, is the property of NBEworks or its licensors and is protected by Japanese and international copyright, trademark, and other intellectual property laws.
  • 3.2 Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content for your personal, non-commercial use, subject to these Terms.
  • 3.3 Restrictions: You may not:
    • 3.3.1: Copy, reproduce, modify, distribute, display, perform, republish, download, store, or transmit any of the content on the Site without our prior written consent.
    • 3.3.2: Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
    • 3.3.3: Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Site.
    • 3.3.4: Use our trademarks, logos, or service marks without our prior written consent.

4. Health Disclaimer

  • 4.1 Informational Purposes Only: The information and coaching Services provided on our Site, including but not limited to blog posts and product descriptions related to Natural Breast Enhancement (NBE), is for informational purposes only and does not constitute medical advice.
  • 4.2 Not Medical Professionals: We are not medical professionals, and nothing on the Site should be construed as a substitute for professional medical advice, diagnosis, or treatment.
  • 4.3 Consult a Healthcare Provider: Before starting any NBE regimen, following any NBE advice, using any NBE products, or making any changes to your health routine, you should consult with a qualified healthcare professional, such as a physician or licensed medical practitioner.
  • 4.4 No Liability for Health Outcomes: We are not responsible or liable for any health outcomes, adverse effects, or consequences resulting from your use of any information, products, or suggestions found on the Site or Services. You assume all risks associated with your use of the Site and its content.
  • 4.5 Individual Results: You acknowledge and agree that the results of using any product may vary.
  • 4.6 Specific Warnings: Do not use any of our Services or methods if you are pregnant or breastfeeding. NBE techniques and substances may interact with certain medications; consult your doctor before use if you are taking any prescription drugs.

5. User Accounts

  • 5.1 Account Creation: If you create an account on the Site, you are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
  • 5.2 Account Security: You agree to notify us immediately of any unauthorized access to or use of your account or any other breach of security.
  • 5.3 Account Termination: We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms, without notice or liability.
  • 5.4 Account Information: You agree to provide accurate and complete information when creating your account and to keep your information up-to-date.

6. Limitation of Liability

  • 6.1 Disclaimer of Warranties: THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • 6.2 Limitation of Damages: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NBEWORKS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • 6.3 Product Liability: Our liability for any defective product is limited to the repair or replacement of the product or a refund of the purchase price, at our option, as described in Section 2.6.
  • 6.4 Maximum Liability: If, notwithstanding the other provisions of these Terms, NBEworks is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the site, NBEworks’s liability shall in no event exceed the greater of (1) the total of any fees paid by you to NBEworks in the six months prior to the date the initial claim is made, or (2) JPY 10,000. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
  • 6.5 Japanese Consumer Protection Law: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Consumer Contract Act of Japan (消費者契約法) or any other applicable Japanese law, which cannot lawfully be excluded or limited.

The Site may contain links to third-party websites or resources. These links are provided for your convenience only and do not constitute an endorsement by us of the content, products, services, or privacy practices of such third-party sites. We are not responsible for the availability, accuracy, or content of these external sites, nor are we liable for any damages or losses arising from your use of them. You access and use third-party websites at your own risk.

8. Privacy Policy

Your privacy is important to us. Our Privacy Policy, available at https://nbe.works/privacy-policy/, explains how we collect, use, disclose, and protect your personal information. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy. Our privacy policy is compliant with GDPR and, critically, the Act on the Protection of Personal Information (APPI) of Japan (個人情報保護法).

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (if you have provided us with your email address) or by posting a prominent notice on the Site prior to the change becoming effective. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

  • 10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of laws principles.
  • 10.2 Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be settled by:
    • (a) Mediation: …mediation in Toranomon, Tokyo, Japan in accordance with the rules of the Japan Commercial Arbitration Association and guidance of JIDRC. If the dispute is not settled by mediation within 90 days of the commencement of the mediation, or such further period as the parties shall agree in writing, the dispute shall be referred to and finally resolved by arbitration in accordance with the following clause (b).
    • (b) Arbitration: …binding arbitration in Toranomon, Tokyo, Japan in accordance with the rules of the Japan Commercial Arbitration Association and guidance of JIDRC. The arbitration shall be conducted in English. The award rendered by the arbitrator(s) shall be final and binding on the parties.
    • (c) Court Jurisdiction: …the exclusive jurisdiction of the courts located in Tokyo, Japan. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum.

11. Indemnification

You agree to defend, indemnify, and hold harmless NBEworks and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the Site; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Site caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Site.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Disclosure of Seller Information

  • 13.1 Compliance with Japanese Law: In accordance with the Act on Specified Commercial Transactions (特定商取引法) of Japan, we will disclose the following seller information upon request: Name/Yagō, Address, Phone Number, Email Address, Representative Name.
  • 13.2 Request Procedure: To request this information, please contact us at [email protected]. We will provide the required information without delay.

14. Entire Agreement

These Terms constitute the entire agreement between you and NBEworks regarding your use of the Site, and supersede and replace any prior agreements we might have had between us regarding the Site.
